1. Acceptance of Terms
By accessing or using the North East Express LLC website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. Where a separate signed transportation agreement, broker-carrier agreement or rate confirmation exists between us, that document controls if it conflicts with these terms.
2. Services
North East Express provides motor carrier transportation and related logistics services, including:
- Full truckload (FTL) dry van shipping
- Refrigerated (reefer) and temperature-controlled transport
- Expedited and team-driven freight
- Dedicated lanes and contract capacity
- Partial and volume LTL shipments
- Specialized, sealed and high-value cargo transport
All services are subject to equipment availability, applicable federal and state regulations, and our standard operating procedures. North East Express operates under USDOT 2298785 and MC 793524.
3. SMS Communications Terms
Consent to Receive Messages
By providing your mobile number and opting in to SMS communications, you consent to receive text messages from North East Express related to:
- Quote responses and rate confirmations
- Pickup and delivery appointment reminders
- Shipment status, ETA and delivery notifications
- Follow-up messages and billing inquiries
- Driver applicant communications, if you applied to drive with us
Consent is not a condition of purchase or of using our services.
Message Frequency and Charges
Message frequency varies. You may receive up to 2 SMS messages per week, with additional messages while a load you asked us to update you on is in transit. Message and data rates may apply according to your mobile carrier's plan.
Opt-Out Rights
You may opt out at any time by:
- Replying STOP to any message from North East Express
- Contacting us at info@northeastxpress.com or (612) 642-2796
- Unchecking the SMS consent box on our forms

For help with SMS messages, reply HELP to any message, or contact us at (612) 642-2796 or info@northeastxpress.com. Mobile carriers are not liable for delayed or undelivered messages. Full details are in our Privacy Policy.
4. Quotes & Pricing
Freight quotes provided through our website, email, phone or text are estimates based on the information you provide. Final pricing may vary based on:
- Actual cargo weight, dimensions, pallet count and commodity
- Actual pickup and delivery locations, including limited-access or residential sites
- Special handling, temperature, appointment or equipment requirements
- Detention, layover, redelivery, TONU and other accessorial events
- Fuel prices and current market conditions
Unless stated otherwise, quotes are valid for 7 days from the date issued. A load is booked when a written rate confirmation is issued and accepted; the rate confirmation governs the rate, equipment, appointment times and accessorial terms for that shipment.
5. Liability & Insurance
North East Express maintains liability and cargo insurance as required by federal law, and certificates of insurance are available on request. Our liability for loss of or damage to cargo is governed by the Carmack Amendment (49 U.S.C. § 14706) and applicable federal and state regulations, and is subject to the limits stated in our insurance policies and any applicable transportation agreement.
Shippers are responsible for properly packaging, blocking, bracing, labeling and describing cargo, and for accurate weights and commodity descriptions. We are not liable for damage caused by improper packaging, shipper-loaded and -sealed freight (SLC), concealed damage, inherent vice, or unreasonable delay by the shipper or consignee. For high-value freight we recommend confirming coverage limits before pickup and arranging additional coverage where needed.
Except as required by law, North East Express is not liable for indirect, incidental, consequential, punitive or special damages, including lost profits, production downtime or loss of business, whether or not we were advised such damages were possible.
6. Cargo Claims
Any visible loss, damage or shortage should be noted on the delivery receipt or bill of lading at the time of delivery. Concealed damage should be reported to us as soon as it is discovered. Written claims must be filed within nine (9) months of delivery (or, for non-delivery, within nine months of the scheduled delivery date), and any lawsuit must be filed within two (2) years and one (1) day of our written claim denial, consistent with 49 U.S.C. § 14706. Claims may be offset against amounts owed under other shipments only where allowed by law or agreement.
7. Payment Terms
Unless otherwise agreed in writing, payment is due net 30 days from receipt of a clean invoice with signed proof of delivery. Quick-pay terms may be available by agreement. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law, and you agree to pay reasonable costs of collection, including attorney's fees. Charges may not be withheld or offset against unrelated claims without our written agreement.
8. Cancellations & Changes
Cancellations or changes to a scheduled shipment must be made at least 24 hours before the scheduled pickup. Late cancellations, or a truck ordered but not used (TONU) after the driver has been dispatched or has arrived, may be subject to a fee as stated on the rate confirmation. Changes to origin, destination, weight, commodity or equipment after booking may change the rate.
9. Detention & Accessorials
Free time at pickup and delivery, detention rates, layover, driver assist, lumper fees, redelivery and other accessorial charges are stated on the rate confirmation for each load. Detention begins after free time expires, is documented by arrival and departure times, and is billed in accordance with the confirmation. We quote accessorials up front — nothing appears on an invoice that was not disclosed in advance or authorized by you in writing.
10. Prohibited Items
We reserve the right to refuse any shipment. We do not transport illegal substances, undeclared hazardous materials, live animals, human remains, firearms or ammunition without prior written agreement, cash or negotiable instruments, or any cargo that violates federal, state or local law. Undeclared hazardous or improperly documented freight may be refused or returned at the shipper's expense.
11. Force Majeure
North East Express is not liable for delay or failure to perform caused by circumstances beyond our reasonable control, including:
- Natural disasters, floods, tornadoes and severe weather
- Road, bridge or border closures and traffic incidents
- Labor disputes, strikes and shortages
- Government actions, regulations, embargoes or public health orders
- Acts of terrorism, war, riot or civil unrest
- Utility, fuel or communications failures
12. Website Use & Intellectual Property
All content on this website — text, graphics, logos, layout and code — is the property of North East Express LLC and is protected by applicable intellectual property laws. You may not copy, republish, scrape or use our content for commercial purposes without written permission. You agree not to use the website to transmit malicious code, attempt unauthorized access, or interfere with its operation. The website is provided "as is" without warranties of any kind.
13. Accessibility
We want this site to be usable by everyone, including visitors using screen readers, keyboard navigation or magnification. We aim to meet WCAG 2.1 Level AA guidance. 14. Dispute Resolution
We would rather solve a problem with a phone call than a filing. If we cannot resolve a dispute informally within 30 days of written notice, disputes arising out of these terms or our services shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, seated in Ramsey County, Minnesota, except that either party may bring an action in small claims court or seek injunctive relief to protect intellectual property or confidential information. Nothing in this section limits rights or remedies that cannot be waived under 49 U.S.C. Subtitle IV, Part B.
15. Governing Law
These Terms and Conditions are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, together with applicable federal transportation law and regulations. If any provision is found unenforceable, the remaining provisions remain in effect.
16. Changes to These Terms
We may modify these Terms and Conditions at any time. Changes take effect when posted to this page with an updated "Last Updated" date, and do not retroactively change the terms of loads already booked under a signed rate confirmation. Continued use of our website or services constitutes acceptance of the updated terms.
